Phew, that's over.

So, court. Went okay, despite the setbacks. The quick version is that both claims were dismissed, which in simple terms means we both walk away and no-one pays anybody any extra money. Which is all I wanted, really - just to clear it up and move on. There's a bit more, but for now, I can feel relieved and go on with my life. Thank-you Mr Referee, you were very fair.



Of course, it started with getting to the court building nice and early only to find no listing for my case at any time for the whole day, and considering it was the court who wrote and told me when to appear... hmm, yes, thank you so much for your usual ability to bungle things, government department.

Anyway, luckily they were accommodating enough to say if I stuck around and the other party showed up, they should still be able to get a referee to take our case as one should be available as soon as one of the other three cases to be heard was finished. Phew, only 25 mins waiting past the appointed time (yes, I actually remembered to take a magazine and so had something to do!) and we got in. The other guy was none too pleased at me, obviously, as he didn't want to even look at me in the waiting room. I was feeling fairly indifferent towards him, myself.

So, his story was reasonably different from mine... I said there were a lot of other cars about, he said there weren't. I said I was two spaces down from where he said I was. I said he was only half out of his carpark, he said he was all the way out. I said I didn't know if he was stopped but I didn't see him pull out, he said he was stopped. Blah blah. All I know is, that's how I remembered it.

The long and the short of it is, I did think it was going to go his way for a bit as the referee put a lot of onus on the fact he said he'd stopped, and I didn't know if he had. In the end, I think I put doubt in the referee's mind as I said he had other discrepencies which weren't borne out by the angle at which the cars connected, so he finally must have seen it was a no-win situation. He said if we couldn't settle, he had to make a decision, which he did, and his decision was to dismiss both claims and neither of us should pay.

At the end of the day, we both paid our insurance excess and both lost no-claims bonuses, although the way this guy was speaking it was as if only he had, or that I didn't care if I did or not!!! Bloody cheek! So, the bad news is that as I was leaving, he asked if he could appeal the decision and asked for an appeal form *pulls hair* So it may not be the last we hear... but for now, it's done with. Yay!

The other thing was just the hassle involved. I had to take a half day off work for it, my Hubby had to go in late to work as he had to look after LF and then collect the girls from school as I didn't know what time I'd be home. Because the thing started late, it meant we finished later than ideal (2.40pm), and I'd just missed both a train and a bus. As it was, the bloody trains weren't behaving and the one due at 3.08pm wasn't running until 3.48pm *grinds teeth* so I had to catch a bus, and of course they're not so frequent either - 3.30pm to get me home at 4.40pm (the good news is at least the bus stop is right outside my house, as compared to the train being a half-hour walk away - tho' Mr H was going to collect me). *sigh*

So, finally home and I really didn't feel up to much else. Did manage to cook dinner and even get everyone into bed (tho' not all asleep) at a reasonable hour. Yay, go me! The five min catnap while dinner was cooking obviously helped!



Good news:

- My aunt rang tonight and she can babysit while Mr H and I go out to dinner this Saturday night coming! WOOHOO!

- [livejournal.com profile] gottalovev, I finally listened to the Colin James! AWESOME! He rocks, and I like his newer stuff as much as I liked the first album when I was in Canada! Thanks for reminding me how great he is!
